Products

Owner's Title Coverage

An owner's policy is optional and protects the borrower if someone challenges a property title based on any title defects that were unknown when the policy was purchased. The coverage protects the borrower and their heirs as long as they have an interest in the property. To obtain this coverage, the borrower pays a one-time premium at closing. In the event there is claim against the title in the future, the title insurer, without expense to the policy holder, will defend the borrower against a challenge to the property title.

We encourage you to speak to your closing attorney about the benefits of title insurance to help you understand the importance of having an owner’s policy and the risk you take when you do not have a policy which gives you protection.

Lender's Title Insurance

A lender's policy protects the mortgage lender if someone challenges a property title based on any title defects that were unknown when the policy was purchased. When a buyer obtains a mortgage in order to purchase their new home, it is usually a loan requirement that the buyer obtain a Lender’s Title Insurance Policy.

The coverage doesn’t provide any protection for the buyer. If there is a complete failure of title, the buyer may have no protection and may lose both the property and the equity in the property. The buyer could also incur legal fees and any tax penalties assessed against the property. A buyer should never presume that the lender obtained title insurance for them.

What is title insurance?

The term “title” refers to all the elements that constitute your legal right to own, use, control, and enjoy real estate.

Before you purchased your home, it may have gone through several ownership changes and the land on which it stands went through many more. A weak link at any point in that chain could cause trouble.

Simply put, title insurance is protection from loss arising from problems connected to the title to your property.

Unfortunately, a defect in your title can have devastating effects if you are not properly insured. You may not be able to take out a home equity loan or you may be denied a building permit for an addition. You might even incur the costs to correct the violation.

Is purchasing title insurance required?

Title insurance is broken into two parts:

  • A lender's policy is mandatory and protects your lender if someone challenges your title to your property
  • An owner's policy is optional and protects the borrower against challenges to their title.

Most lending institutions will not loan you money on a home or other property unless a mortgagee title policy is purchased. Title insurance will repay the balance of your mortgage if a claim against the property voids your title ownership to the property.

What period does title insurance cover?

Title insurance generally only protects against losses arising from events that occurred prior to the date of the policy. Coverage ends on the day the policy is issued and extends backward in time for an indefinite period.

This is in marked contrast to property insurance, which protects against losses resulting from events that occur after the policy is issued, for a specified period into the future.

How long does title insurance stay in effect?

Lender's policies remain in effect until the loan is repaid. Most lenders require the purchase of a new Lender's title policy if you refinance your home because the existing policy expires when the existing mortgage loan is paid off. You are entitled to a premium discount on a new Lender's policy for the same property if you refinance within the first seven years.

An owner's policy remains in effect as long as you or your heirs have an interest in the property.

Steps in the title process

Initial Request

An order for title insurance is opened with a title officer. A preliminary report can be issued with a minimum of information, without even identifying the buyer. It shows the record title as it presently exists and is only an offer to provide insurance.

On-Site Searching and Examining

A title officer performs three searches: Property, Name, and Tax searches. From that information, a preliminary report is created.

Technical Review

Once a preliminary report is issued, a technical analysis of the documents of the record begins. This view of all recorded matters is made to evaluate their impact on the title to the property.

Inspection Analysis

In anticipation of coverage, an inspection of the site is ordered. From the inspection report, the title product is amended to show any encroachments or other matters which would ultimately impact the title.

Information we collect

We collect personal information that is necessary to enable us to establish and to provide services, in each case, as permitted or required by applicable law. The personal information we collect varies depending on the services you request and use.

We may collect and (as described below) disclose nonpublic personal information about you that we obtain from the following sources:

  • Information we receive from you on applications and other forms.
  • Information about your transactions with us, our affiliates, or others.
  • Information we receive from consumer-reporting agencies.

The term “personal information,” as used in this privacy policy, means information that identifies you personally. We may use information that does not personally identify you to help manage our business and to provide us, our affiliates or other companies insight into consumer behavior within our company and on our website. We may use this aggregate, anonymous information even if you ask us to limit the disclosure of your personal information as described herein.

Information we share

We do not sell or provide personal information to third parties for telemarketing or any other independent use.

Third Party Vendors. To offer you products and services that help you achieve your financial goals, we may, however, share information with our affiliates and selected companies with which we contract in order for them to provide services on our behalf.

To protect your privacy, we work only with third party vendors that contractually agree to (a) maintain strong confidentiality protections; (b) limit their use of any personal information to which they have access to those functions that are necessary to perform the services that we have contracted with them to provide; and (c) agree that they will not sell to other third parties the information we provide to them.

Such affiliated companies may include, but are not limited to, financial service providers, mortgage companies, and real estate brokerage firms.

Nonaffiliated Third Parties. We do not share your personal information with nonaffiliated third parties that are not third party vendors (as described above).

Information of Former Customers. If you are no longer a customer of Virginia Statewide Title Services or its affiliates, we will not share information we have collected about you, except as permitted or required by law.

Sharing of Information as Permitted by Law. We also may share information about you in other ways as required by law or as permitted to properly manage our business.

How we protect your information

We restrict access to your personal information to those employees who have a business purpose in utilizing your data. To protect your nonpublic personal information, we maintain physical, electronic and procedural safeguards that comply with federal regulations and leading industry practices and we also require third party vendors working for us to protect your information.

Online communication/Internet users

Regular emails you may send to us are not secure against interception by unauthorized individuals. Therefore, we ask that you not send nonpublic personal information, especially social security numbers, through regular email. Likewise, we will not transmit through regular email sensitive or nonpublic personal information that can compromise or violate a user’s privacy.

We use Internet cookies to facilitate your use of the Virginia Statewide Title Services website. A cookie is a data file that a web server places on your computer when you visit a site that, among other things, enables the site to recognize repeat visits from that computer and to display settings that you have previously selected through that computer. To take full advantage of the features and level of security that the Virginia Statewide Title Services website offers, your Internet browser must meet certain requirements, such as supporting 128 bit encryption, and being set to allow our servers to create a cookie on your system.

Choices

Limiting Information we use for Marketing. We do not release your personal information to affiliates for purposes of marketing. If you establish a direct relationship with one of our affiliates, they may market to you directly – and you may address any requests to cease such marketing directly to such affiliates. Otherwise, to the extent that you receive any marketing materials relating to our affiliates’ services, such communications come directly from Virginia Statewide Title Services and you may exercise your opt-out rights as discussed below.

Email Communication Opt Out. We may periodically send educational and informational emails about our products and services, or those of our affiliates, to customers for whom we have recorded email addresses. All customers who receive these emails have the opportunity to opt out of this service at any time by sending the request to memsvc@vacu.org
